Although Elizabeth represents clients in contested litigation when necessary, she prefers to use negotiation and mediation to help clients resolve their conflicts through uncontested litigation. This is best for everyone involved, and minimizes the acrimony between the spouses, which is also in the best interests of the children.

Pre-filing Negotiation

In cases where parties desire to resolve their disputes without resorting to litigation, Elizabeth is able to engage in discussions and negotiations prior to filing an action with the court. Thereafter, once an agreement is reached, Elizabeth will prepare the Agreement, file the case as an uncontested matter, and finalize the matter.

Litigation

Litigation is necessary in cases where the parties are not able to agree. Elizabeth strongly believes that when possible, negotiation, mediation, and collaborative approaches should be used to resolve family disputes for the wellbeing of the family and the children.  

In Elizabeth’s collaborative practice, she represents clients in achieving a mutually fair and equitable end to their relationship without the anxiety, stress, and financial cost that often accompanies litigation. As a result, the integrity and health of family relationships are kept intact.

Prenuptial and Postnuptial Agreements

These agreements address issues such as property distribution, estate planning, and alimony. They are specific to the parties’ goals, objectives, and circumstances and require the knowledge and expertise of an experienced divorce attorney in order to have thoughtful and durable agreements.

Both prenuptial and postnuptial agreements deal with property distribution, or support and alimony in the event of divorce, breakup, or the death of one of the spouses. Neither a prenuptial or postnuptial agreement can resolve issues related to child support or timesharing, each of which must be determined at the time of divorce.
